Marrying a Malaysian Part 1: Registering Your Marriage In Malaysia

Cross-border marriage generally gives us more headaches when it comes to its legal preparation as compared to "local marriage". I am not an exception too. 

I am a typical Singaporean girl who will get married to my Malaysian boyfriend soon. Just in case where you are also a foreigner planning to register your marriage in Malaysia with your Malaysian spouse,  you will realize how complicated the preparation of the legal documents can get.

I am documenting my experience in preparing and submitting some of the paperwork to relevant authorities in both Singapore and Malaysia in order to get the approval to register my marriage in Malaysia.

Before I start, let me explain why am I choosing to have my marriage registered in Malaysia instead of Singapore where the processes are often seem to be more hassle-free. The main reason is to simplify the whole process for my long term social visit pass application in order for me to settle down permanently in Malaysia.

The following below are the steps to complete before you could file a marriage application with the relevant Malaysian authories:

1. Obtain a Single Status Letter from your home country

It is a requirement for all foreign spouse to obtain a Single Status Letter/ Letter of Impediment from your home country. In my case, it's Singapore. However, unlike other countries, Registry of Marriages (ROM) Singapore is unable to issue such letter. I have obtained an original certified true copy of search result of marriage records from ROM Singapore instead to show my eligibility to marry. Singaporeans can apply for a copy of the result of marriage records here : https://www.marriage.gov.sg/civil/marriage-records/search-marriage-records

** Note: The Single Status Letter is only valid for 6 months if there is no date stated on it.

2. To attest and certify the Single Status Letter
After getting my original certified true copy of search result of marriage records from ROM Singapore, I proceeded to Ministry of Foreign Affairs, Consular Service Office, Singapore to have the piece of document legalized. The process took less than 10 mins to complete. There is a SGD 10 service fee charged for this. You could check out on the link below for more details.

After getting the document stamped by the consular office, I proceeded to the Malaysia High Commission in Singapore to get it certified. However, this time, the process took about 3 days before I can collect the stamped document from the Malaysia Embassy in Singapore.

** Note: Please remember to bring along a copy of your NRIC/Passport before you proceed to the Consular service counter.

3. To reside in the district of marriage for at least 7 days

All foreign spouses are required to reside in the district of marriage for at least 7 days before the application of marriage can be filed to the relevant authorities in Malaysia. So, I booked a bus ticket and stayed in Malaysia for a week.

4. Re-certify the Single Status Letter at Wisma Putra, Putrajaya

Be sure that you are have fulfilled step 3 before you proceed to visit Wisma Putra. Similarly, at the Wisma Putra, proceed to the Consular service section to have the Single Status Letter certified. Be prepared to wait for longer time this time. The whole process took about 2 hours for me.

5.  JPN Office, Putrajaya to submit the marriage application

Before you proceed to the Marriage & Divorce counter, please check if you have the following documents with you.

Original & Photocopy of:
 
1. MyKad, MyPR or Malaysian green card (that is still valid).
2. Passport and photocopy of pages with personal details, the latest arrival date in Malaysia and a valid visa or pass for non-citizen.
3. One (1) colour passport-sized photograph per applicant.
4. Approval letter from the Immigration department for the student pass and temporary employment pass holders to register their marriage in Malaysia.
5.1. Birth Certificate for non-citizen ( I think this is only for applicant age below 18)
5.2. Decree nisi absolute (divorce certificate), if applicable.
5.3. Death certificate of previous spouse, if applicable.
5.4. Single Status Letter

When you have these documents ready, please proceed to the counter. The officer should hand you Form JPN.KC02 for you to fill it up. Please note that Form JPN.KC02 is entirely in Malay language.

6. Submit Letter of Approval to respective JPN office

The last step is to bring the Letter of Approval issue by JPN Putrajaya to the respective JPN office which you have choose to have your marriage solemnize. Please have the documents listed in step 5 ready again for re-submission at the respective JPN office.

** Note: For Malaysian who wish to marry their foreign spouse, you could only choose to have the marriage solemnize at the JPN office. Solemnizing at other venues such as church or temples will not be allowed.

    1. Hi, you will need to update your marriage in Malaysia and obtain a Malaysia Marriage cert in order to apply for LTSVP in Malaysia. However, this step is not neccessary if you have registered your marriage in Malaysia

    For the One (1) colour passport-sized photograph per applicant.

    Do I just submit my normal SG passport size photo, or do I have to take those with blue background? like for Malaysian passport.

    My wife and i just did rom in singapore last month, we were reminded by singapore rom officer to register in high commission of Malaysia, singapore.

    2. There is no simpler way for you to obbtain Malaysia marriage certificate. This is why I aways advise people to register their marriage in Malaysia if they plan to apply for a LTSVP. It does not matter whether she is Malaysian previously or not. Since she has chosen to give up her Malaysia citizenship, then you will have to follow the law for Singaporean.

    Morning. I have a bit confuse at step 2 & 4 which certified the single status letter . As i understand from Malaysia goverment, when we got it the original certified true copy of search result of marriage records from ROM we have to proceed to MFA for legalised . After that , can proceed to Ministry of foreign affairs, malaysia(at Kl)for verified the such document . But from your experience , 1st you go to MFA for legalised,then 2nd you go to Malaysia embassy in sinagapore for certified , and 3rd you re-certified again in KL consular service before you proceed to JPN.May i know , is it the same if i legalised my document at MFA 1st, then straight proceed to ministry of foreign affairs,malaysia(at Kl) which can skip the step at malaysia embassy in singapore for certified ? Kindly notified me if i was wrong , thanks a lot.

  13. I'm a Filipino about to marry a Malaysian. We're getting a marriage license next week but I'm planning to go home and come back after a month to get married. I don't want to waste my return ticket. But my question is, can I be granted an extension of my social visit pass for the purpose of getting married? We have to wait 3 weeks at least before we can get the ceremony after getting the license.

    Thanks for the information, I was wondering if you know if it's possible my Malaysian bf and I got married abroad and afterwards registering it Malaysia's ROM? Would I have the same process as you when later on I want to register LTSVP?

    If I don't register my marriage in Malaysia, what are the extra steps i have to do when applying LTSVP?

      You will need to update your marriage in Malaysia and obtain a Malaysia Marriage cert if you get married abroad.

    Is there a need to register in Singapore within 6 months after we register in Malaysia? Because as per http://www.kln.gov.my/web/sgp_singapore/birth_marriage_cert website, we must register in Malaysia within 6 months if we chose to ROM in Sg. We want to reside in both Msia and Sg but won't do the Sg ROM so soon.

    I and my bf went to Ministry of Foreign Affairs Malaysia to endorse his document. They told us he need go to Mexico where is birth cert need to be stamp by the malaysian embassy at mexico. My question is, once we settle our endorsement document and fill up the Form JPN.KC02, how long we need to wait for the JPN to give us a date to marriage solemnize at the JPN office? is that going to take a month or 3 months or more?   20. I just did my rom in sg.We were told tonendorsed our marriage in malaysia.i am muslim and he is christian.we had a civil marriage in sg. Will it affect anything during the endorsement of docs?

    I have one question is that I have read from somewhere that we have to wait for 6 months after the day you register your marriage in order to apply for the LTSVP. Is this true? Or you can apply straightaway after you receive your marriage certificate?

    I have 2 question where with regards to Step 5 on the part of original and photocopy latest arrival date in Malaysia and a valid visa/pass for non citizen. Can i enter malaysia as a tourist and still be considered to have a valid visa/pass for non citizen?

    1. Because it's not cheap to let your children study in Malaysia if they are foreigner. Furthermore, the paperworks are pretty troublesome too. Unless, you have other plans to send them to other countries. If you plan to settle down in Malaysia for good, I will advise that you register your marriage in Malaysia first. It is not a must for you to register your marriage in Singapore. Of course, you can also choose to register in Singapore also.

    I am also a foreigner and staying now in KL to process for my marriage registration with my Malaysian bf. My 30 days tourist visa is not enough to complete the registration. Do you have ideas if the immigration will just easily extend my visa for the reason of marriage application or I will exit to other nearby countries to visa extension? Thank u.

      I believe you can either apply to extend your visa or visit Singapore. Personally, I feel visiting Singapore will be the easier way.

    I would like to clarify on the 7 day requirement. Per my understanding, it commences from the entry date stamped in the passport. Thus, suppose a would-be foreign spouse enters on 2 January (say a Wednesday), can steps 4,5 & 6 be completed on 9 January? Some sources say the requirement is actually 7+1 day but nearly marriage blogs seem to mention 7 days.

    Nice job on the blog. Singaporeans get a 30 day Short Tem Social Visit Pass entering Malaysia.
    My question is whether you had to request an extension of this during the marriage process?

    That’s because of - (a) reside in marriage district for 7 day requirement , (b) 21 day waiting period after booking solemnisation date with JPN.

    I’m in this predicament where there’s a risk the 7+21 days might exceed the 30 day Visit Pass my fiancée will be given.
    We are planning to apply for the LTSVP after the marriage solemnisation.

    We can either go to SG/Thailand to re-enter OR go to Immigration office to extend Short Tem Social Visit Pass.
    I would prefer the latter but not sure whether Immigration allows it since “Marriage” is not part of the business list of Short Term Social Visit Pass.

      The 7 days requirement is for you to submit your application for marriage. After I submitted, I went back to Singapore because my solemnisation date is 3 months later. You need not be in Malaysia during the 21 day waiting period after booking a solemnisation date with JPN. I only moved to Malaysia a week before the solemnisation date. Application for LTSVP will take 7 days to process. But I recently heard there will be a 6 month marriage rule applied to new application. Not sure whether this apply to male foreign spouses only or to female too.

      If you planned to settle down in Singapore permanently, then it is best that you register your marriage in Singapore but remember to re-register in Malaysia too. After marriage, you can try apply for a Long term social visit pass for your wife in Singapore.

      For muslim, the procedure is a little different. There are more requirements to be met. You might want to find it out with the relevant authorities.

    Im a Malaysian. And my bf is a Singaporean. He just got divorced 1 month ago. And as he is staying in government rental HDB, he need to marry me soon to put my name under the HDB so that he can keep place longer. Because we are planing to stay in Singapore for another 2 years before we settle down in Malaysia. We will also be buying a property in Malaysia soon while staying in Singapore. At the same time, before all that, i will be needing to have Sg LTVP to stay in Singapore with him for 2 years before he comes over to Malaysia to settle down with me.

    So what would you suggest for us, get registered in Malaysia or Singapore ?

    1. Hi,

      You might want to consider registering your marriage in both countries. Anyway, you will have to register your marriage in Malaysia within 6 months. If not you will have pay a penalty for that. However, it is not a requirement for you register your marriage in Singapore. But since you are planning to stay in Singapore for a period of time, I would suggest that you register in Singapore as well.

  38. But where should i register 1st in order to get Singapore LTVP without much trouble ? Can i register in Malaysia 1st then apply for the Sg LTVP ? It shouldnt be a problem right ? Or should i register in Singapore 1st instead, then following with in Malaysia within 6 months ? Which you think would be a better option ?

    1. Singapore and Malaysia are two different countries. To apply for Singapore LTSVP, you need to register your marriage in Singapore. Likewise, you would need to register your marriage in Malaysia in order for your Singaporean husband to apply for Malaysian LTSVP. The order is not important as long as you register your marriage within the time frame.

      I think you may consider to marry in Singapore to make you LTVP easier, like wise both need to prepare many documents as well. If you marry in SG, you just need to submit your SG marriage cert to Msia high comm within 6months to "re-register", fees is $10 if i not mistaken then 3 days later to collect the Malaysia Marriage cert x2 original copies.

    My fiance (foreigner) and I are planning to register our marriage here in Malaysia. He will be arriving in KL, and I'll drive down from Penang to meet him to submit all documents at Putrajaya before returning to Penang NRD for our marriage.
    I'm wondering whether the 7 day rule apply after we submit the documents to Putrajaya prior submission to state NRD office, or it counts after date of arrival in Msia?

    In your case, it was 7 days after your arrival, then document submission to Putrajaya. I've visited the state NRD and steps told was not in the order like how you have gone through. If you could clarify this for me, that's very helpful in planning our trips.

      I have to wait for 7 days after my arrival in order to submit my application for marriage. But I am not sure whether the rule has changed. So it is better to follow what the state NRD office told you.

    Your post is very helpful but some parts I still abit confusion.
    I am a Malaysian and my husband who is Singaporean. We are ROM in Singapore on 2014 and we have one child who also Singaporean. My husband who working in Sg and currently I am no working. We often in and out of Singapore. Recently, I am planning to apply long term visit pass for them. But the website shown as before apply, principal holder must have a valid Employment Pass. Supporting letter from the employer and Authorisation letter from the employer. So will does my husband be eligible to apply the long terms visit pass? what the necessary documents are required and preparation prior to immigration office.

    1. Hi Jannice,

      I recently read that the rules have changed (Malaysia-style). In order to apply for LTSVP for a foreign spouse, you will need to have a Malaysian sponsor with an income. Previously, the Malaysian sponsor can be anyone, but now I heard that the immigration has changed the rule. The Malaysian sponsor has to be the Malaysian spouse. There is some income requirement (I think at least RM 2K) that you need to fulfill too. So basically, the immigration is trying everything to make it difficult for foreign spouse to get LTSVP these days. It is really frustrating.

    1. Hi, If I am not wrong, Residence Pass needs to be renewed every 5 years at a fee but it is not required for PR. LTSVP needs to be renewed also. Usually for 6 months to a maximum of 5 years. But 5 years is hard to get.

    1. Hi, I believe the procedures are somewhat the same. But there might be additional steps and documents required by the now. You will need to visit the immigration office to obtain the checklist.

  45. Hi Elin, Im also a Singaporean, planning to go Penang next year for marriage. As u have mentioned, the procedures are quite an hasssle. Currently, I have obtained my single cert (ROM marriage search record) & extraction of my birth cert...I will bring this 2 certs to be attested by MOFA & MHC in Singapore. My question is - does Wisma Putra accepts the Single cert? As mentioned in the letter, it said that this letter does not have any legal capacity for one to marry outside Singapore. Any issues on that when you submitted to Wisma? In your documents you mentioned about approval letter...it will be given by wisma when they attested the single cert? Cos someone told me that after wisma attested those certs, I need to bring back to JPN HQ in Penang to get the approval letter. and my concerns is about the 1 month visa in msia, im afraid of insufficient time to do this and that. most likely i also need to request for visa extension meantime while doing those paper work & 21 days notice. I was also advised to apply visa extension in putrajaya instead of the one in penang. have u heard about withdrawal of 21 days notice with payment of RM100 (subject to approval)?

    1. Hi Joyce, I have done this years ago, so I am not sure whether the procedures have changed.

      To answer your question, yes, Wisma Putra accepted the single cert that I obtain from ROM Singapore and they were able to re-certify it. The approval letter is issued by JPN Putrajaya. I am not sure for Penang as my husband is from Kuala Lumpur.

      But currently due to Covid-19, I am not sure whether you will be able to enter Malaysia based on marriage purposes. There is no indication when Malaysia will open its borders to foreigners.

      There is no need for you do everything in a month if the entry ban is lifted. You can choose which date to register your marriage after 21 days notice. The dates are limited, so you can exit the country and re-enter again after choosing a date.

    2. Hi Elin, thank you for replying. I have applied MyTravelpass & had approval from Msia Immigration to enter Malaysia. So meantime I am preparing for the marriage documents in SG. I doubted the travel ban will be lifted that soon, that's why I don't wanna risk of going back to SG (need quarantine) & re-apply for approval (another quarantine) then will use alot of $$$. I intend to apply LTVP after get the marriage certificate.

      In that case, I believe you will need to apply a visa extension in order to stay beyond 30 days. I am not sure whether you can do that in Penang. You might have to get it from Putrajaya.

      Some people mentioned that there is a 6 months cooling periodafter marriage before you are allowed to apply a LTSVP. I am not sure whether this rule still apply during this pandemic. During my time, there is no such rule and all Singaporeans will get 1 year LTSVP upon application. The rule might have changed now since the current government is trying make things difficult for foreigners.

    1. Hi, your Malaysian bf don’t need to apply and will not be able to apply the single status letter in Singapore. Only you need to apply for the single status letter in singapore to register your marriage in Malaysia

      Malaysians are not required to obtain the single status letter if you are registering your marriage in Malaysia. JPN should have the record in their system. You only need to get your single status letter endorsed. But that was almost 9 years ago. I am not sure whether it has changed.

    Are there any possible obstacles or difficulty that we possibly foresee if we do not do it with ROM in Singapore?

    In my scenario, I will be working in Singapore, getting a flat and starting a business till at least until child birth(estimate 2 years after marriage) before I decide to relocate in Malaysia. Will it be better to ROM in Singapore or it makes no different?

    1. Hi, you can also ROM in Singapore, but remember to also register your marriage in Malaysia within 6 months after you complete your ROM in Singapore.

    I saw your side note, mentioned that
    For Malaysian who wish to marry their foreign spouse, you could only choose to have the marriage solemnize at the JPN office. Solemnizing at other venues such as church or temples will not be allowed.

    Is this law still applies? I can't seem to locate this law. Thank you In advance!

    1. It’s not a written law. This is what the JPN office told me. I was only allowed to solemnize at the JPN office. Maybe different JPN office has different rules

How long does it takes all in all? Will i get to chose my exact ROM date?

    2. Hi, You can search and apply for your single cert from the following website: https://www.marriage.gov.sg/civil/marriage-records/search-marriage-records

      It took a few days for me to receive the hardcopy single status record from ROM by mail. For foreigner to marry in Malaysia, you can't really choose your ROM date. There will be a list of available dates provided by JPN Malaysia for you to choose. Also, you can only solemnize your marriage at the JPN office. I got all the attestation and documents submission for marriage application done within two weeks. But this depends how much free time you have.
